SWINDON TOWN: Judgement delivered in Town ownership row

A High Court judge ruled that Lee Power is the rightful owner of Swindon Town this morning

A High Court judge ruled that Lee Power is the rightful owner of Swindon Town this morning

A HIGH Court judge has ruled in favour of Swindon Town chairman Lee Power at the end of a long ownership battle.

Nicholas Strauss QC delivered his judgement at the Rolls Building in London this morning, making Power the majority shareholder in Seebeck 87 Ltd and controller of the football club.

Power and fellow club director Sangita Shah were in attendance in court to hear the decision but Jed McCrory, former chairman of Town, was not present.

McCrory will have to pay for both sides' legal fees - a minimum of £50,000 - reportedly within 28 days.

More follows later.

Still, at least its over (hopefully). Now back to football matters, and hopefully some decent signings.

Dear Sam/Beren

Would be extremely grateful if you could explain to us the EXACT ownership structure post the Court's decision please?

Power: majority owner. Is this 60%? Who owns other 40%? Does he have the right to buy it?

Update also on the other court case about Jed stealing money from the club would be helpful.

Then yes let's go back to football, but these are massively important matters for all Town fans. The status and viability of our club is sacrosanct.

Yours

ALL Town fans.

Ps We can then move on to putting pressure on power to grow up with his relationship with The Adver..... But please help us out first....!!

No surprise that the judge has thrown that claim out after disbelieving the evidence, but a relief non the same. Bit silly taking a £50k gamble when his evidence appeared to be a bluff?

"Power the majority shareholder in Seebeck 87 Ltd and controller of the football club" Does that mean McCrory and his gang remain as minority shareholder or (shareholders) in that company? If so could they cause further mischief or damage or do they no longer have a voice?

I was hoping that's the last we hear of McCrory at Swindon and he can focus on his tu'penny ha'penny football club ownership fantasy elsewhere...

Very, very pleased for Power and Cooper who have worked as a team on pitch matters. I do believe Crouch will have to up his act on the admin side now and hopefully now this is out of the way not only players will be incoming but perhaps further investors.

I do believe that the matter of £300k also has to be resolved, this is the matter Power was taking Jedco to court for. Well done to Power and especially well done to the judge for seeing through the Luton Lager Lout's dastardly scheme, and branding him in court for what he is. Give that man an S/T. Am looking forward now to some good club news about players and new investors now this dross has been cleared up.

PS: Up yours Jed, and now go get £50k to pay the costs, LOL, LOL and LOL again.

Certainly good news. Wonder if he can/will appeal though? I hope Power pursues him through the courts over the other matter. If he gets a criminal conviction, presumably that would be enough to ensure he fails the owners and directors test and doesn't get another chance to control a football club. Interesting that his mate Agombar got in at Hereford, despite doing 7 years back in the 80s for the systematic hijacking of lorries. Presumably that one's been written off with the passage of time.

1) do we really need all the info as many posters above have requested - it is a private limited company after all and the owners are entitled to a degree of privacy on some of the intimate matters of their business. I know we all want to know what is happening with our club but unless we stump up our own cash to own it we don't really have those rights. The club has been in the public eye enough recently, let's just get on with talking about football, signings and the new season. The accounts are published annually, that's enough.
2) McCrory won't be able to make the club bankrupt to pay the £50k. He cannot sue the club for the legal costs he has incurred by losing the court case brought against the club where the club has won. That just wouldn't be allowed to happen.
3) What rights of appeal does McCrory have open to him - presumably there are routes for him to go down if he wanted to. No doubt he will be discussing those options with his lawyers. Doing this would not only have the potential to reverse the decision but also delay him having to pay the £50k. This would be more costly for the club if an appeal process was undertaken.

onwards and upwards, glad this dark cloud has gone!!

I interpret it as Seebeck 87 owned 100% of the club. Power then gave money to McCrory for 60% of Seebeck 87 with his company Swinton 20 but didn't document it.

Think that is what McCrory was disputing saying that transaction wasn’t valid.

But judge has ruled that was a valid transaction so Power (via Swinton 20) owns 60% of Seebeck 87 and McCrorys lot own 40%. Seebeck 87 still the owning company.

So I guess that gives Power the power to block McCrory putting the 3 new directors on the board of Seebeck 87, but not sure what now happens to McCrorys 40%. If Power is funding it then guess it's not too important, although if there are any profits etc McCrory will want his share.

Imagine a final settlement for the 40% people to go away may follow?
